1. Introduction and Acceptance
Welcome to EscapeMind Room. These Terms of Service ("Terms") constitute a legally binding agreement between you and EscapeMind Room, operating at 8 Logic St, Canberra ACT 2600, Australia. By accessing our website, making a booking, or participating in any of our escape room experiences, workshops, or events, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
If you do not agree with any part of these Terms, you must not use our services or access our facilities. We reserve the right to modify these Terms at any time, and such modifications will become effective immediately upon posting. Your continued use of our services after any changes constitutes your acceptance of the revised Terms.
2. Booking and Reservations
All bookings must be made in advance through our official website, email, or phone. When you make a reservation, you agree to provide accurate, current, and complete information about yourself and all participants. We reserve the right to refuse or cancel any booking at our sole discretion.
- Bookings are confirmed only upon receipt of full payment or valid deposit as specified during the booking process.
- You must arrive at least 15 minutes before your scheduled game time. Late arrivals may result in reduced game time or forfeiture of your booking without refund.
- The minimum number of participants is 2 persons, and maximum capacity varies by room (typically 6-8 persons).
- Participants under 16 years of age must be accompanied by an adult guardian throughout the experience.
- Group bookings for corporate events or workshops require at least 48 hours advance notice.
3. Cancellation and Refund Policy
We understand that plans may change. Our cancellation and refund policy is designed to be fair to both our customers and our business operations:
- Cancellations made more than 48 hours before the scheduled time are eligible for a full refund or can be rescheduled without penalty.
- Cancellations made between 24-48 hours before the scheduled time will receive a 50% refund or may reschedule with a 25% rebooking fee.
- Cancellations made less than 24 hours before the scheduled time are non-refundable and non-transferable.
- No-shows will forfeit the entire booking amount without refund.
- In exceptional circumstances (medical emergencies, natural disasters), we may offer alternative arrangements at our discretion.
- We reserve the right to cancel any booking due to unforeseen circumstances, in which case you will receive a full refund or alternative date.
4. Safety and Conduct Rules
Your safety and the safety of all participants is our highest priority. By participating in our escape room experiences, you agree to abide by all safety rules and staff instructions:
- Follow all instructions provided by EscapeMind Room staff members at all times during your experience.
- Do not force, break, or damage any props, locks, furniture, or equipment. Excessive force is never required to solve puzzles.
- Emergency exits are clearly marked and accessible at all times. You may exit the room at any time if needed.
- Photography and video recording are permitted only with prior staff approval and must not disrupt other participants.
- Intoxication or being under the influence of drugs or alcohol is strictly prohibited. We reserve the right to refuse entry to anyone appearing intoxicated.
- Aggressive, threatening, or inappropriate behavior toward staff or other participants will result in immediate removal without refund.
- No food or beverages are allowed inside escape rooms (except water in sealed containers).
- Smoking, including e-cigarettes and vaping, is prohibited throughout the facility.
5. Health and Liability Waiver
Participation in escape room activities involves physical and mental challenges. By booking and participating, you acknowledge and accept the following:
- You are in adequate physical and mental health to participate safely in the activities.
- You have disclosed any medical conditions, disabilities, or special requirements that may affect your participation.
- Activities may involve dim lighting, confined spaces, loud noises, and moderate physical activity.
- Pregnant women, individuals with heart conditions, claustrophobia, epilepsy, or other serious medical conditions should consult with our staff before participating.
- You participate at your own risk and agree to release EscapeMind Room from any liability for injuries, losses, or damages sustained during your visit, except in cases of proven negligence on our part.
- We maintain comprehensive insurance coverage, but participants are responsible for their personal belongings and valuables.
6. Intellectual Property Rights
All content, designs, puzzles, themes, storylines, graphics, logos, and materials associated with EscapeMind Room are protected by copyright, trademark, and other intellectual property laws. This includes but is not limited to:
- All escape room themes, narratives, and puzzle designs are original works owned by EscapeMind Room.
- You may not reproduce, distribute, modify, or create derivative works from any of our proprietary content.
- Sharing puzzle solutions, room secrets, or detailed gameplay information online or in public forums is discouraged to preserve the experience for future participants.
- The EscapeMind Room name, logo, and branding materials may not be used without our express written permission.
- Website content, including text, images, and design elements, is protected and may not be copied or reproduced without authorization.
7. Privacy and Data Protection
We are committed to protecting your privacy and handling your personal information responsibly. Collection and use of your data is governed by our Privacy Policy, which should be read in conjunction with these Terms. Key points include:
- We collect personal information necessary for bookings, communication, and service delivery.
- Your data is stored securely and never sold to third parties for marketing purposes.
- We may use your contact information to send booking confirmations, service updates, and promotional materials (you may opt out at any time).
- Video surveillance is in operation throughout our facilities for security and safety purposes.
- Game sessions may be monitored for safety and quality assurance purposes.

8. Gift Vouchers and Promotional Offers
Gift vouchers and promotional offers are subject to specific terms and conditions:
- Gift vouchers are valid for 12 months from the date of purchase unless otherwise specified.
- Vouchers must be presented at the time of booking and cannot be redeemed for cash.
- Promotional discounts cannot be combined with other offers unless explicitly stated.
- We reserve the right to modify or discontinue promotional offers at any time without prior notice.
- Lost or stolen vouchers cannot be replaced or refunded.
9. Limitation of Liability
To the maximum extent permitted by Australian law, EscapeMind Room's liability is limited as follows:
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of our services.
- Our total liability for any claim shall not exceed the amount you paid for the specific booking in question.
- We are not responsible for personal belongings lost, stolen, or damaged on our premises.
- Force majeure events (natural disasters, pandemics, government actions, etc.) that prevent service delivery will not constitute a breach of these Terms.
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.
10. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Australian Capital Territory and the Commonwealth of Australia. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of the Australian Capital Territory.
Before initiating any legal proceedings, parties agree to attempt to resolve disputes through good faith negotiations. If a resolution cannot be reached within 30 days, either party may pursue formal legal remedies.
